Quốc hội và Hội đồng nhân dân được gọi là cơ quan đại biểu cho nhân dân vì họ được nhân dân bầu ra, phụ trách trước nhân dân, hành động thay mặt cho nhân dân và gắn bó chặt chẽ với nhân dân.

Quốc hội và Hội đồng nhân dân được gọi là cơ quan đại biểu cao nhất của nhân dân vì các lý do:
- Đại diện cho quyền lực của nhân dân: Quốc hội và Hội đồng nhân dân được bầu ra bởi nhân dân, thể hiện quyền lực của nhân dân. Quốc hội thực hiện quyền lập hiến, quyền lập pháp, quyết định các vấn đề quan trọng của đất nước và giám sát tối cao đối với hoạt động của nhà nước.
- Thực hiện chức năng, nhiệm vụ của nhà nước: Hiến pháp quy định chức năng, nhiệm vụ của Quốc hội và Hội đồng nhân dân. Quốc hội có nhiệm vụ, quyền hạn thực hiện quyền giám sát tối cao việc tuân theo Hiến pháp, luật và nghị quyết của Quốc hội.
- Phản ánh ý chí, nguyện vọng của nhân dân: Quốc hội và Hội đồng nhân dân là nơi phản ánh một cách trực tiếp nhất ý chí, nguyện vọng của nhân dân.
